ನವದೆಹಲಿ: ಸಿಬಿಐಯ ಮಾಜಿ ವಿಶೇಷ ನಿರ್ದೇಶಕ ರಾಕೇಶ್ ಅಸ್ಥಾನ ಮತ್ತು ಡಿಎಸ್‌ಪಿ ದೇವೇಂದರ್ ಕುಮಾರ್ ಅವರಿಗೆ ಲಂಚ ಪ್ರಕರಣದಲ್ಲಿ ಕ್ಲೀನ್ ಚಿಟ್ ನೀಡಿ, ಮನೋಜ್ ಪ್ರಸಾದ್ ವಿರುದ್ಧ ದಾಖಲಿಸಿದ ಸಿಬಿಐ ದೋಷಾರೋಪ ಪಟ್ಟಿಯನ್ನು ದೆಹಲಿಯ ರೋಸ್ ಅವೆನ್ಯೂ ಕಾಂಪ್ಲೆಕ್ಸಲಿನ ಸಿಬಿಐ ವಿಶೇಷ ನ್ಯಾಯಾಲಯವು 2020 ಮಾರ್ಚ್  07ರ ಶನಿವಾರ ಅಂಗೀಕರಿಸಿತು.

ಸಾರ್ವಜನಿಕ ಸೇವಕರಾದ ರಾಕೇಶ್ ಅಸ್ಥಾನ ಮತ್ತು ದೇವೇಂದರ್ ಕುಮಾರ್ ವಿರುದ್ಧ ಸಾಕಷ್ಟು ಸಾಕ್ಷ್ಯಾಧಾರಗಳಿಲ್ಲ ಎಂಬುದಾಗಿ ವಿಶೇಷ ಸಿಬಿಐ ನ್ಯಾಯಾಧೀಶ ಸಂಜೀವ ಅಗರ್‌ವಾಲ್ ಅವರು  ತಮ್ಮ ಆದೇಶದಲ್ಲಿ ತಿಳಿಸಿದರು.

ತಮ್ಮ ವಿರುದ್ಧ ಅಲೋಕ್ ವರ್ಮ ಕುಮ್ಮಕ್ಕಿನಿಂದ ’ಕಲ್ಪಿತ’ ಎಫ್ ಐಆರ್ ದಾಖಲಿಸಲಾಗಿದೆ ಎಂದು ಮೊದಲ ದಿನದಿಂದಲೂ ಪ್ರತಿಪಾದಿಸುತ್ತಲೇ ಬಂದಿದ್ದ ರಾಕೇಶ್ ಅಸ್ಥಾನ ಅವರಿಗೆ ವಿಶೇಷ ಸಿಬಿಐ ನ್ಯಾಯಾಲಯದ ಆದೇಶವು ಭಾರೀ ನಿರಾಳತೆಯನ್ನು ಒದಗಿಸಿತು.

ಆರೋಪಿಗಳು ಎಂಬುದಾಗಿ ಹೆಸರಿಸಲಾಗಿರುವ ಮನೋಜ್ ಪ್ರಸಾದ್ ಮತ್ತು ಸೋಮೇಶ್ ಪ್ರಸಾದ್ ಅವರ ವಿರುದ್ಧ ದೋಷಾರೋಪ ಪಟ್ಟಿಯಲ್ಲಿ ಮಾಡಲಾಗಿರುವ ವಂಚನೆ ಮತ್ತು ಕ್ರಿಮಿನಲ್ ಸಂಚು ಆಪಾದನೆಗಳನ್ನು ನ್ಯಾಯಾಲಯವು ಪರಿಗಣನೆಗೆ ತೆಗೆದುಕೊಂಡಿದೆ.

ಸೋಮೇಶ್ ಪ್ರಸಾದ್ ಅವರನ್ನು ದೋಷಾರೋಪ ಪಟ್ಟಿಯಲ್ಲಿ ಹೆಸರಿಸಲಾಗಿರಲಿಲ್ಲ, ಆದರೆ ಈಗ ಅವರಿಗೂ ಆರೋಪಿಯಾಗಿ ಸಮನ್ಸ್ ಹೊರಡಿಸಲಾಗಿದೆ. ಏನಿದ್ದರೂ ಮನೋಜ್ ಪ್ರಸಾದ್ ಅವರನ್ನು ದೋಷಾರೋಪ ಪಟ್ಟಿಯಲ್ಲಿ ಆರೋಪಿಯಾಗಿ ಹೆಸರಿಸಲಾಗಿದೆ.

ಮಾಜಿ ಸಿಬಿಐ ವಿಶೇಷ ನಿರ್ದೇಶಕರಾಗಿರುವ ರಾಕೇಶ್ ಅಸ್ಥಾನ ವಿರುದ್ಧ ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ಕಾಯ್ದೆಯ (ಪಿಸಿ ಕಾಯ್ದೆ) ಸಂಬಂಧಿತ ವಿಧಿಗಳ ಅಡಿಯಲ್ಲಿ ೨೦೧೮ರ ಅಕ್ಟೋಬರ್ ೧೫ರಂದು ಕ್ರಿಮಿನಲ್ ಸಂಚು, ಭ್ರಷ್ಟಾಚಾರ ಮತ್ತು ಕ್ರಿಮಿನಲ್ ದುರ್ವರ್ತನೆ ಆರೋಪಗಳನ್ನು ಹೊರಿಸಲಾಗಿತ್ತು. ಒಂದು ದಿನದ ಬಳಿಕ ದೆಹಲಿಯಲ್ಲಿದ್ದ ಮನೋಜ್ ಪ್ರಸಾದ್ ಅವರನ್ನು ಬಂಧಿಸಿದರೆ, ಡಿಎಸ್‌ಪಿ ದೇವಿಂದರ್ ಕುಮಾರ್ ಅವರನ್ನು ಒಂದು ವಾರದ ಬಳಿಕ ವಶಕ್ಕೆ ತೆಗೆದುಕೊಳ್ಳಲಾಗಿತ್ತು.

ಕೇಂದ್ರೀಯ ತನಿಖಾ ದಳವು (ಸಿಬಿಐ) ೨೦೨೦ರ ಫೆಬ್ರುವರಿ ೧೧ರಂದು ಮನೋಜ್ ಪ್ರಸಾದ್ ವಿರುದ್ಧ ದೋಷಾರೋಪ ಪಟ್ಟಿಯನ್ನು ದಾಖಲಿಸಿ, ಅಸ್ಥಾನ ಮತ್ತು ದೇವೀಂದರ್ ಕುಮಾರ್ ಅವರಿಗೆ ಕ್ಲೀನ್ ಚಿಟ್ ನೀಡಿತ್ತು. ಅಸ್ಥಾನ ಅವರು ಪ್ರಸ್ತುತ ಮಾದಕ ದ್ರವ್ಯಗಳ ನಿಯಂತ್ರಣ ದಳ (ಎನ್‌ಸಿಬಿ) ಮತ್ತು ನಾಗರಿಕ ವಿಮಾನಯಾನ ಭದ್ರತಾ ದಳದ (ಬಿಸಿಎಎಸ್) ಮುಖ್ಯಸ್ಥರಾಗಿದ್ದಾರೆ.

ಪ್ರಕರಣ ದಾಖಲಾದ ಮೊದಲ ದಿನದಿಂದಲೇ ಅವರು ತಮ್ಮ ವಿರುದ್ಧ ಅಲೋಕ್ ವರ್ಮ ಕುಮ್ಮಕ್ಕಿನಿಂದ ’ಕಲ್ಪಿತ’ ಎಫ್‌ಐಆರ್ ದಾಖಲಿಸಲಾಗಿದೆ ಎಂದು ಹೇಳುತ್ತಲೇ ಬಂದಿದ್ದರು. ಸಿಬಿಐ ನಿರ್ದೇಶಕರಾಗಿದ್ದ ಅಲೋಕ್ ವರ್ಮ ಅವರ ಭ್ರಷ್ಟ ಚಟುವಟಿಕೆಗಳನ್ನು ತಾವು ಅದೇ ವರ್ಷ ಆಗಸ್ಟ್ ತಿಂಗಳಲ್ಲಿ ಸಂಪುಟ ಕಾರ್‍ಯದರ್ಶಿಯವರ ಮುಂದೆ ಬಯಲು ಮಾಡಿದ ಬಳಿಕ ತಮ್ಮ ವಿರುದ್ಧ ’ಕಲ್ಪಿತ’ ಎಫ್‌ಐಆರ್ ರೂಪಿಸಲಾಯಿತು ಎಂದು ಅವರು ಹೇಳಿದ್ದರು.

ಅಲೋಕ್ ಕುಮಾರ್ ಅವರು ಸತೀಶ್ ಬಾಬು ಸನಾ ಅವರಿಂದ ೨ ಕೋಟಿ ರೂಪಾಯಿಗಳನ್ನು ಪಡೆದಿರುವುದಾಗಿ ಅಸ್ಥಾನ ಅವರು ಸಿವಿಸಿ ಮತ್ತು ಸರ್ಕಾರಕ್ಕೆ ಮಾಹಿತಿ ನೀಡಿದ್ದರು.

ಮನೋಜ್ ಪ್ರಸಾದ್ ಅವರು ಸನಾ ಅವರಿಗೆ ಸಿಬಿಐಯಲ್ಲಿನ ತಮ್ಮ ’ಉತ್ತಮ ಸಂಪರ್ಕ’ಗಳನ್ನು ತಿಳಿಸಿದ್ದರು ಮತ್ತು ಅವರ ಸಹೋದರ ಸೋಮೇಶ್ ಅವರು ೨೦೧೭ರಿಂದ ಅಸ್ಥಾನ ನೇತೃತ್ವದ ವಿಶೇಷ ತನಿಖಾ ದಳ (ಎಸ್‌ಐಟಿ) ತನಿಖೆ ನಡೆಸುತ್ತಿದ್ದ ಮೊಯಿನ್ ಖುರೇಷಿ ಪ್ರಕರಣದಿಂದ ಹೊರಬರಲು ನೆರವಾಗುವರು ಎಂದು ತಿಳಿಸಿದ್ದರು ಎಂದು ಎಫ್‌ಐಆರ್ ಹೇಳಿತ್ತು.

ಸೋಮೇಶ್ ಅವರನ್ನು ತಾನು ದುಬೈಯಲ್ಲಿ ಭೇಟಿ ಮಾಡಿದಾಗ ’ಅಸ್ಥಾನ ಅವರು ಖಚಿತವಾಗಿ ಕೆಲಸ ಮಾಡಿಕೊಡುತ್ತಾರೆ ಏಕೆಂದರೆ ದುಬೈ ಮತ್ತು ಲಂಡನ್ನಿನಲ್ಲಿ ಕಳೆದ ಹಲವಾರು ವರ್ಷಗಳಿಂದ ಅಧಿಕಾರಿಯ (ರಾಕೇಶ್ ಅಸ್ಥಾನ)  ಹೂಡಿಕೆಗಳನ್ನು ಅವರೇ (ಸೋಮೇಶ್) ನಿಭಾಯಿಸಿದ್ದುದಾಗಿ’ ಹೇಳಿದ್ದರು ಎಂದು ಸನಾ ಅವರು ಪ್ರತಿಪಾದಿಸಿದ್ದರು.

‘ಸೋಮೇಶ್ ಅವರ ವಾಟ್ಸಪ್‌ನಲ್ಲಿ ಅಸ್ಥಾನ ಅವರ ಫೊಟೋಗಳು ಇದ್ದುದನ್ನು ಗಮನಿಸಿದ ನಾನು ಒಂದು ಕೋಟಿ ರೂಪಾಯಿಗಳ ಮೊದಲ ಕಂತನ್ನು ದುಬೈಯಲ್ಲಿ ಮನೋಜ್‌ಗೆ ಮತ್ತು ೧.೯೫ ಕೋಟಿ ರೂಪಾಯಿಗಳನ್ನು ಮನೋಜ್ ಜೊತೆ ಸಂಪರ್ಕದಲ್ಲಿದ್ದ ಸುನಿಲ್ ಮಿತ್ತಲ್ ಅವರಿಗೆ ೨೦೧೭ರ ಡಿಸೆಂಬರ್ ೧೨ರಂದು ದೆಹಲಿಯ ರೈಸೀನಾ ರಸ್ತೆಯಲ್ಲಿನ ಪ್ರೆಸ್ ಕ್ಲಬ್ ಆಫ್ ಇಂಡಿಯಾದ ಪಾರ್ಕಿಂಗ್ ಪ್ರದೇಶದಲ್ಲಿ ನೀಡಿದೆ’ ಎಂದೂ ಸನಾ ಹೇಳಿದ್ದರು.

ಇದಲ್ಲದೆ ೨೦೧೮ರ ಅಕ್ಟೋಬರ್ ೧೦ರಂದು ೨೫ ಲಕ್ಷ ರೂಪಾಯಿ ಮತ್ತು ೨೫,೦೦೦ ದಿರ್‍ಹಮ್‌ಗಳು (ಅಂದಾಜು ೫ ಲಕ್ಷ ರೂ) ಮತ್ತು ೩೦,೦೦೦ ದಿರ್‍ಹಮ್‌ಗಳನ್ನು (ಸುಮಾರು ೬ ಲಕ್ಷ ರೂ) ಹೆಚ್ಚು ಕಡಿಮೆ ಅದೇ ಅವಧಿಯಲ್ಲಿ ದುಬೈಲ್ಲಿ ಮನೋಜ್‌ಗೆ ಪಾವತಿ ಮಾಡಿದುದಾಗಿಯೂ ಸನಾ ಆಪಾದಿಸಿದ್ದರು.

೨೦೧೭ರ ಡಿಸೆಂಬರಿನಲ್ಲಿ ತಾನು ದುಬೈಯಲ್ಲಿ ಇದ್ದಾಗ ಸೋಮೇಶ್ ಅವರು ಇಬ್ಬರು ಸಿಬಿಐ ಅಧಿಕಾರಿಗಳ ಸಂಭಾಷಣೆಯನ್ನು ದೂರವಾಣಿಯಲ್ಲಿ ತನಗೆ ಕೇಳಿಸಿದರು ಮತ್ತು  ಅದರಲ್ಲಿ ಒಬ್ಬರ ಧ್ವನಿ ಅಸ್ಥಾನ ಅವರದ್ದಾಗಿತ್ತು ಎಂದೂ ಸನಾ ಹೇಳಿದ್ದರು.

ಅಸ್ಥಾನ ಅವರಿಗೆ ಕ್ಲೀನ್ ಚಿಟ್ ನೀಡಿದ್ದನ್ನು ಅಂಗೀಕರಿಸಿ ಶನಿವಾರ ನ್ಯಾಯಾಲಯವು ನೀಡಿದ ಆದೇಶ ಈಗ ಅಸ್ಥಾನ ಅಥವಾ ಕುಮಾರ್ ವಿರುದ್ಧ ಇನ್ನು ಯಾವುದೇ ಪ್ರಕರಣವೂ ಬಾಕಿ ಉಳಿದಿಲ್ಲ ಎಂಬುದನ್ನು ಸೂಚಿಸಿದೆ.

New Delhi: Expressing anger over the ‘leak’ of CBI chief Alok Verma’s confidential response to a CVC report on corruption charges against him, the Supreme Court on Tuesday,  20^th November 2018,  said none of the parties involved deserves a hearing.

The response was filed by Verma and submitted to the secretary general in a sealed cover on Monday, 19^th November 2018.

A bench comprising Chief Justice Ranjan Gogoi and Justices SK Kaul and KM Joseph handed over to senior advocate Fali S Nariman, appearing for Verma, the copy of a report by a news portal, which has published the CBI director's response.

Nariman after going through the media report told the bench that he was "shattered" and "shocked" on Verma's reply being leaked in the media.

The senior lawyer said the news portal and its journalists concerned be summoned as the press should be free and responsible.

"We don't think any of you deserves a hearing,” the bench said and adjourned the matter for November 29.

Verma had approached the apex court challenging the Centre's decision to divest him of his duties and sending him on leave following his feud with Special CBI Director Rakesh Asthana, who has levelled corruption allegations against him. Asthana has also been divested of his duties and sent on leave.

The feud turned murkier on Monday with senior CBI officer MK Sinha alleging that NSA Ajit Doval, Union minister Haribhai Parthibhai Chaudhary and CVC KV Chowdhury interfered in the probe against Asthana.

KV Chowdhury did not respond to queries when his reaction was sought while Doval, the National Security Advisor, was not immediately available for comments. The Union minister termed the allegations as baseless and malicious.

Sinha, who was probing the FIR against Asthana, the CBI's number 2, and important cases like the PNB scam involving Nirav Modi, made a litany of sensational allegations in his petition before the Supreme Court that sought urgent hearing for quashing his transfer to Nagpur.

Advocate Sunil Fernandes, appearing for Sinha, informed a three-judge bench headed by Chief Justice Ranjan Gogoi that his client has "got some shocking revelations" in his petition and had sought urgent listing and hearing Tuesday along with Verma’s plea.

"Nothing shocks us," the bench, also comprising Justices SK Kaul and KM Joseph, said, as it ruled out urgent hearing. The court asked Fernandes to be present in the court when it hears Verma's plea.

In his 34-page petition, Sinha, a 2000 batch IPS officer from Andhra Pradesh cadre, alleged that the CBI director briefed Doval on October 17 about registration of a case against Asthana.

Sinha, while supporting the affidavit of Deputy Superintendent of Police officer AK Bassi, who has also been transferred to Andaman and Nicobar Islands involved in the bribery case (relating to Asthana) but the "Director CBI did not give immediate permission and reverted that the NSA has not permitted the same.", claimed Bassi favoured immediate search of public servants

New Delhi: Supreme Court led by Chief Justice of India Ranjan Gogoi on Friday 26^th October 2018, ordered the Central Vigilance Commission to continue investigation against Alok Verma under the supervision of a retired Supreme Court judge and set a two weeks deadline to complete the probe.

Nageshwar Rao will remain interim CBI chief for now, but Decisions taken by him from October 23 till date shall not be implemented, said  Supreme Courtand posted the case on November 12 for next hearing.

CJI ordered to place all decisions taken by  Rao in sealed cover. He also asked Rao to place the CVC investigation report in sealed cover and submit it to the Court.

On Friday’s hearing, in addition to a petition by Verma, Court also included a petition by non-profit organisation Common Cause, which also wanted the court to assign a special team to probe corruption charges against CBI special director RakeshAsthana.

Verma and Asthana have been locked in a feud with both accusing the other of corruption, a situation that the government cited to send out a dramatic order issued overnight to send them both off duty. The Central Vigilance Commission said it had attempted to look into allegations against Verma but he didn’t cooperate.

Both petitions – Verma’s as well as the one filed by Common Cause – sought the removal of Asthana from CBI and the quashing of the order issued to appoint M Nageswar Rao as interim chief.

The Supreme Court said the CVC inquiry on allegations and counter-allegations in the nasty feud between CBI Director Alok Verma and Special Director Rakesh Asthana should be completed in 10 days under supervision of court. The Centre and the CBI were asked by the SC to provide the CVC report to court in a sealed cover within 10 days. Upon this direction, the CVC pleaded that 10 days for CBI enquiry is not enough as it has to look into several documents. The top court then granted two weeks' time to the CVC for concluding the probe.

Earlier, CBI Special Director Rakesh Asthana also moved Supreme Court challenging the decision of the Centre to divest him of his duties and sending him on leave.

The Supreme Court Friday commenced hearing on the petition filed by CBI Director Alok Kumar Verma challenging the decision of the Centre to divest him of his duties and sending him on leave. A bench of Chief Justice Ranjan Gogoi and Justices S K Kaul and K M Joseph heard the plea.

Senior advocate F S Nariman is advanced the arguments on behalf of the CBI chief. The counsel submitted that the CBI Director was appointed with the approval of a selection panel having the Prime Minister, the Leader of Opposition and the Chief Justice of India. Nariman referred to the Central Vigilance Commission (CVC) and Centre's orders divesting Verma of his duty.

He also cited the Vineet Narain judgment to support Verma's pleas. Verma has also sought stay of the Centre's order asking him to proceed on leave and giving the interim charge of his post to Joint Director M Nageswara Rao, a 1986 batch Odisha-cadre IPS officer.
